Dear Mr Rudd

I write to you with the hope that you take the time to read the
following.

	                   RE:  The Future of People With Disabilities

As time goes on, and we all grow old, we begin to ponder the future.
Where will we end up when we are no longer able to care for
ourselves.  After 21 years of fighting for independence and a private
fulfilling life, I've come to realise that this will always remain a
dream which will never become a reality.  In the past,
deinstitutionalisation became the "in" thing.  Then came advocacy
groups demanding everybody with a disability be deinstitutionalised
come what may.  In reality advocacy groups have done what they were
set up to prevent.  Advocacy groups have lumped all people with
disabilities in one basket instead of treating them as individuals
with individualised needs and dreams.  They forgot those who require
24 hour care or those who like sheltered environment or even those
who from time to time require or desire a centre based lifestyle with
24 hour assistance at hand.

Governments have tried to resource people with disabilities and it is
not working due to:-
Lack of flexibility.
Lack of funds.
Lack of planning.
Lack of decision makers' [at the top] knowledge / experience of the
disability field at ground floor level.
Lack of direction.
Lack of providing accommodation choices i.e. alone, pairs, centre
based, or nursing home.
Lack of long-term sustainability.
Isolation.
Loneliness.
Depression.
Lack of choice [flexible carers' times].
Lack of meal opportunities.
Safety concerns. [i.e. fire, burglary, falls within the home].
Health deterioration issues, etc.

Western Australia is well known for their high standard of treatment
of people with disabilities, as are South Australia and Victoria.
Queensland fall a long way behind in this area. DSQ need to improve
the way they offer services to People With Disabilities (PWD). Since
1992 the State and Federal Governments have had an agreement that PWD
have their rights to live their life as normal as possible.  This is
not happening in Queensland. The Disability Services Act "same basic
human rights as other members of society" is not acted upon.

In the U.S.A. I'm personally aware of two young [44 and 18] disabled
women in a nursing home and yet U.S.A. has all these fancy worded
policies that supposedly are to protect such people. The government
does not care. Australia is heading down the same track.

As PWD grow older their support needs change but this isn't in-built
into their funding packages so they have only one option to look
forward to- nursing homes.  Deinstitutionalisation will never become
a reality and we need to accept that now and find a half-way point.
	 Unless we do that the disability sector will become a "window
dressing" operation with executives flushed financially while people
with disabilities become increasingly isolated in their house / flat
within the community or in nursing homes.

In no way am I advocating a return to the old style institutional
facilities run by staff where people with disabilities were
controlled.  I'm not saying that deinstitutionalisation has not
improved things, - it has - but we have gone too far to the right. We
need to come back to the middle and provide a semi-independent
accommodation option for PWD i.e. a cluster-house like set-up.
Cluster-house complexes exist now operated by Housing Qld.  Why can't
Disability Services Qld [DSQ] and Housing Qld. work together and
provide such an option?  In 2004 I stayed at a caravan park in
Brisbane.  I had a cabin decked out for PWD.  This started me
thinking.  A lifestyle such as a caravan park set-up could be a
viable option for those requiring or wanting communal type living.
People could live separately but have the option of communal
resources. Yes this communal type living will go against most of the
deinstitutionalisation push but in reality a communal type living
option needs to be taken seriously. It would be:
Cost Effective.
Increase security.
Increase the scope of sharing carers.
Increase participation options.
Decrease isolation.

At present, it's one or the other.  There's no choice. A third
option would be to have somebody move in but there again that would
be the individuals choice.  Stuff like compatibility, trust and
privacy issues would arise. Giving people with disabilities lifestyle
options seems to be well documented but in reality advocacy groups
and governments have denied us options.

I fear for the future because people with disabilities are being put
into the community and left to rot by governments while they build
empires within government supposedly to enhance the lives of those
with disabilities.  If these empires were dismantled and that money
redirected to ground-floor disability services life would be more
hopeful for PWD.

As my Cerebral Palsy and health worsens I wonder where I'll end up
when I can no longer sustain a quality of life within the community,
receiving six hours of care a day.  Sleep-ins are increasingly
desired but difficult to arrange. Isolation has increased. Body
weakness has increased which increases the risk of falls etc.

Governments constantly change and with that comes shifts in
policies.  I know that this is universal but the day-to-day lives of
people with disabilities are personally dictated by government
policies - more so than that of able-bodied people. Flexibility can
not be obtained within the present disability services' award.  I can
not expect a carer who comes at 7am to come back at 9am.  So I can
sleep in.  It maybe feasible but is it impractical, unreasonable and
unfair on the carer. I wouldn't relax for those two hours, knowing I
may be ruining the carer's day. Theory provides answers to all
situations in life but in reality the lack of money severely shortens
the flexibility of lifestyle options for people with disabilities
regardless of thousands of theoretical options being suggested.

Cluster type housing is more cost effective than individual units and
people going to nursing home facilities, which are already overloaded
with the aged. Cluster housing would mean the sharing of resources
both monetary and human.

Sustained security for people with disabilities will only be achieved
by a cluster-house type set-up with 24 hour help on-site.  The
foundation of the human life consists of relationships of varying
kinds and depths.  PWD who have grown up in institutions, are exposed
to relationships existing through payment of staff.  These
relationships are not based on choice.  They are forced upon PWD.
Deinstitutionalisation has not changed this situation.  Sure PWD may
choose their carers but those people may be all they see for weeks on
end. This isolates PWD proving deinstitutionalisation isn't working.
We need to acknowledge this and address it.

THIS NEGLECT AND ABUSE HAS TO STOP.

My name is Vicki.  I have no use of my arms and legs due to a spinal
cord injury I incurred as a result of a car accident 27 years ago.

My experiences with DSQ over last year and this year have left me
with a very jaded point of view of the department.  Perhaps the
Federal government is as much to blame but I think both the Federal
and Queensland government are oblivious as to how many talented,
hard-working and eager people there with disabilities within the
community that they could tap into INSTEAD of just promoting public
servants (or worse still, employing more).

Just briefly: This year I was asked by a friend why there was not a
24/7 backup service for people with disabilities in emergency
situations. My reply was as follows:

"You have asked the million-dollar question when it comes to a
backup service 24/7. The only time I or one of my colleagues has
approached the DSQ about this type of service, it has been dismissed
out of hand or the usual financially impossible rhetoric comes out.
There is an independent service (partially government funded) called
MACS which operates in a narrow corridor in the northern suburbs of
Brisbane. MACS operates between 6 p.m. and 6 a.m. of a night-time.
They do regular short visits every night and, if you are lucky
enough to be a client, they also act as backup in an emergency.
Their services are totally free which is pleasant for a change. I am
very pro MACS.

Myself and a few colleagues, approached DSQ for funding to do a
submission for a similar service (eventually expanding to 20/7) to
operate in the southern and western suburbs in March 2007. We were
screwed around by DSQ for nine months! Finally in January, I
received confirmation that DSQ agreed to fund a submission. $5,750
was the total figure. We all got together and organised as well as
did all the research only for me to a receive a phone call in March
to say that the funding was being taken back and going towards
another large service provider on the south side to start a
service!  As consumers or I should say victims of service providers,
we (people with disabilities) know all too well that large
organisations cannot manage specialised groups/services any year as
well as small groups of people with disabilities can!

I have never been treated so badly or with such little regard as in
this situation. (This is the abridged version of the story of
course.) One thing it has made me fully aware of is that you can
never trust DSQ. The way they treat people with disabilities is
abysmal! Naturally I wrote a letter of protest to the Minister and
my local state parliamentarian and eventually got a letter back from
some lackey in DSQ that basically stated there was not a snowball's
chance in Hades of DSQ changing their mind. ".

John, I had heard in church that "the Lord giveth and the Lord
taketh away". Until this year, I never knew the Lord lived in
disability services Queensland.

DSQ releases plans for Funding Reform in "Growing Stronger"
This month DSQ released what seems to be the results of the "Have
Your Say on Funding Reform" consultation. The document titled
Growing Stronger outlines DSQ's future vision for the way funding
will be administered in Queensland.  The main reforms include the
introduction of a single application process for all services funded
by DSQ, a standard and uniform assessment process and matching to
available service options.
Previously funding was tagged to the individual and they could then
chooses what services best suited them or move service should they
be unhappy with the service's performance. It was Individualised. It
seems that now the funding is tagged to the service and individuals
are offered a place in that service. The assessment process will
decide what services are best for the individual. If the individual
chooses not to accept an offer for a place in a service, it will be
given to the next person on the priority list.
These changes will also include people who already receive funding
and it seems their funding will be merged into to this new system.
Therefore we understand that people who currently have support
arrangements will also be assessed.
Over the next 4 years DSQ will invest $52 million in the development
of the Growing Stronger initiative. It appears that nearly half of
this ($23.5 million) will go towards introducing the assessment
process, a "person-centered approach to delivering specialist
disability services through tailored service responses informed by
assessment outcomes" and improving service management. However, over
half ($28.5 million) will go to the establishment of an information
system to aid in the prioritisation process.
The Minister states in the Growing Stronger document that DSQ "can
work smarter with the funds we do have." The document talks about
person centered approaches and individual tailed responses, however
we wonder if this is possible given the assessment and matching
process that is described.
QDN will be meeting with senior DSQ staff to discuss the new system
and ask a whole lot of questions, like how will the assessment
process be developed and what happens if people with disability are
not happy with the result of their assessment.

	 AS YOU LAY IN BED, YOU FELT FORGOTTEN, SCARED, LONELY,
CONTROLLED, AND JUST A NUMBER LOST IN A SYSTEM WHERE YOU HAD NO
RIGHTS, AND YOU DIDN'T MATTER.

DISABILITY SERVICES QLD. [DSQ], WHO IS RETURNING THE CARE OF PEOPLE
WITH DISABILITIES TO THE DARK AGES WHERE THEY HAD NO RIGHTS, VOICE OR
FREEDOM.
	 DSQ HAS BECOME A LARGE INSTITUTION WHICH IS DESTROYING THE
DREAMS AND LIVES OF PEOPLE WITH DISABILITIES BY ADOPTING A "BE SEEN,
NOT HEARD" MENTALITY MIXED WITH A STRICT AUTHORATIVE ATTITUDE WHICH
GOES AGAINST THE DISABILITY ACT '92.
	 THE STAFF STRUCTURE AT DSQ ABSORBS MILLIONS OF DOLLARS NEEDED
BY PEOPLE WITH DISABILITIES TO LIVE IN THE COMMUNITY.
YET, WHEN PEOPLE WITH DISABILITIES SEEK AN INCREASE IN FUNDING, DSQ
CRIES "POOR" AND INSTRUSIVELY QUESTIONS HOW THEIR FUNDING IS SPENT,
AND THREATEN THEM WITH DEFUNDING IF THEY DO NOT FIT INTO DSQ'S
GUIDEGUIDES WHICH, IN MY CASE, WERE WRITTEN 17 YEARS AFTER I LEFT
INSTITUTIONALISED LIVING.
THIS AMOUNTS TO NEGLECT AND ABUSE.
	 THIS IS A GROSS MISUSE OF PUBLIC MONEY BY A INCOMPETENT
GOVERNMENT DEPARTMENT WHOSE EXISTENCE IS TO THE DETRIMENT OF PEOPLE
WITH DISABILITIES, AND YET, NOBODY CARES.
	 AT NIGHT, I LAY AWAKE, SEEING NO FUTURE IN LIVING IN THE
COMMUNITY BECAUSE OF DSQ, AND ITS INTRUSIVE MANNER IN WHICH IT
OPERATES.
	 THE INSTABILITY OF FUNDING THAT DSQ PROVIDES CREATES A
CONTINUOUS UNCERTAINITY FOR PEOPLE WITH DISABILITY.  THIS INSECURITY
MAKES PLANNING FOR THE FUTURE UNINVITING, SO WHY LIVE IN THE
COMMUNITY.
	 WHY CONTINUE TO TRY TO LIVE IN THE COMMUNITY WHEN, AT ANY
TIME, DSQ CAN STOP FUNDING YOU.
	 NEXT MONTH WILL MARK MY 21ST YEAR OF LIVING IN THE COMMUNITY,
YET  AS I LAY IN BED NOWADAYS, I FEEL FORGOTTEN, SCARED, LONELY,
CONTROLLED, ISOLATED, AND JUST A NUMBER LOST IN A SYSTEM WHERE I HAVE
NO RIGHTS, AND I  DON'T MATTER.

I have had no dealings with them, I am on the dspension only, the
only assistance I get is from pqlifestyle---they seem like they have
build themselves a nice little empire.

the Disability Act '92, - the very document DSQ exists to uphold.

	 This makes deinstitutionalisation in Qld. unobtainable,
pushing PWD into nursing homes at early age by refusing to provide an
easy sliding scale of increasing funding from a central bucket of
money.

	 Instead DSQ forces PWD to:-

1. Look else where funding to survive day-to-day in the
community.

2. Forces PWD to do cart-wheels to apply for increased funding.

This breaks the right of PWD to:-

1. Maintain their privacy.

2. Maintain their right to choose.

3. Maintain their indepenendence.

4. Live a lifestyle of their choice.

All this when DSQ receives funding galore.

This funding goes into expanding DSQ's already over-growded
management dynasty which
shuffles paper, and treats PWD like idiots who can't think, and who
don't know their own day-to-day needs.

DSQ needs to re-think this, before they face class action in the
courts which is not as silly as it sounds due to:-

1. DSQ ignores the principles of the Disability Act '92.

2. DSQ necglects the needs of PWD.

3. Creating undue pressure for PWD.

4. Creating a very uncertain for PWD.

5. Pushing PWD into nursing homes by not providing adequate
responsive funding.

6. Creating a growing management dynasty which prevents funding
getting to PWD.

I challenge DSQ to think before PWD die because of its in-action and
power games DSQ currently plays with the lives of PWD.

UNDERSTAND EVERY THING SAID TO ME.  I RESPOND ON A COMMUNICATION

		 DESPITE MY DISABILITIES, I RECENTLY GRADUATED FROM
TAFE WITH A DIPLOMA OF COMMUNITY EDUCATION AFTER SEVEN YEARS OF STUDY.
		 AS A PERSON WITH DISABILITIES WHO IS CREDITED WITH
PIONEERING DEINSTITUTIONALISATION IN QUEENSLAND, I'M WRITING TO YOU
THROUGH SHEER FRUSTRATION WITH THE QLD. STATE GOVERNMENT WHO TREATS
PEOPLE WITH DISABILITIES LIKE THIRD CLASS CITIZENS.
		 DEINSTITUTIONALISATION IN QLD. HAS ONLY CHANGED
THE "BRICKS AND MORTAR" STUFF, NOT THE "REAL LIFE" STUFF.  WE ARE
BEING PUT INTO THE COMMUNITY, BEING ENCOURAGED TO LIVE "NORMAL"
LIVES, BUT THIS GOVERNMENT REFUSE US THE REQUIRED MEANS TO MEET OUR
BASIC DAY-TO-DAY SURVIVAL NEEDS.
		 THE HUMAN RIGHT TO HAVE LUNCH ON A REGULAR BASIS IS
DENIED TO US.  EVEN THE RIGHT TO GO TO THE TOILET WHEN NATURE CALLS
IS DENIED TO US.
		 IN MY CASE, THESE THINGS ARE CAUSING MEDICAL PROBLEMS
WHICH ULTIMATELY PUTS EXTRA STRAIN ON THIS STATE'S ALREADY STRETCHED
HEALTH SYSTEM.
		 THE LIVES OF PEOPLE WITH DISABILITIES ARE BEING
ENDANGERED BY THE QLD. GOVERNMENT'S "DISPLAY CABINET" APPROACH.
		 THE PREMIER, MR. BEATTIE IGNORES PEOPLE SUCH AS
MYSELF, AND ALLOWS ABUSE OF PEOPLE WITH DISABILITIES.  HE REWARDS THE
ABUSERS WHILE HE TELLS THE ABUSED TO GO JUMP.
		 THIS WAS EVIDENT WHEN HE REFUSED TO PAY COMPENTATION
TO VICTIMS OF ABUSE OF AN SERVICE PROVIDER [COOTHARINGA] IN
TOWNSVILLE, BUT THEN GAVE COOTHARINGA MILLIONS OF DOLLARS RECENTLY
OVER A LAND SALE DEAL.
		 MR. BEATTIE HAS REPEATEDILY REFUSED TO COMMUNICATE
WITH ME.
		 THE FEDERAL / STATE DISABILITY AGREEMENT NEEDS URGENT
REVIEWING AS THIS BEATTIE LABOUR GOVERNMENT IS GROSSLY MISHANDLING
DISABILITY FUNDING.
		 QLD'S CURRENT DISABILITY MINISTER, MR. W. PITT IS
A "CLAYTON'S" MINISTER WHO IS PROPOSING FUNDING CHANGES THAT WOULD
SEVERELY IMPACT ON THE LIVES OF PEOPLE WITH DISABILITIES.  HE ALSO
REFUSES TO COMMUNICATE WITH ME.
		 PLEASE, SIR, I BEG YOU TO INITIATE AN URGENT INQUIRY
INTO QLD'S DISABILITY AGREEMENT WITH THE FEDERAL GOVERNMENT.
		 I THANK YOU FOR YOUR TIME TAKEN READING THIS LETTER.
