That's identical to Blowhole FM here on 88.1.  They are using it as a link a few hundred metres across town to a 80 watt commercial licence at the Polytech.  I guess abuse of spectrum will not be included in the proposed ruling.  The Studio is at the 88.1 location.

The ban on linking is an absolute one.  I understand that this will be a problem for people living in gullies and less than ideal transmission spots but laws have to be enforceable and if a loophole is left it will be exploited by the less sincere operators.  There is no way of putting a "good intentions" provision into rules like these.  The concern that the MED has is that a high vantage point is being used by some semi-commercial operators which is blocking the use of this service by the people that it is intended for.  We have seen examples where a single operator is saturating an entire area using most of the band by linking in-band and having multiple transmitters.
 
Perhaps I am feeling a bit smug because I live on top of a hill in Wellington and can see the Hutt valley, the airport, Kapiti and the city, and if I put up a 1/2 watt signal it could be recieved by just about everybody in Wellington!  Mind you, if you had to put up with the wind that I do you might consider that living in a gully has its good points too and I doubt if I could keep a decent antenna on the roof for more than a few months!
 
When the notice is posted, it will be at www.govt.med.nz/rsm/whatsnew  for a month or so.  After that you will need to dig for it in the "Licensing" pages.  As far as I am aware, there is no intention to change the text from what I put up during the week as it is considered to meet the wishes of most users.  I have been passing on comments from the group to our policy section where appropriate.  I can assure you that some of them have sparked lively debate!

As for my own position well I guess I am fortunate in that I live in an relitively flat ie valley area sourounded on 3 sides by high hills were there is little other fm broadcasts (more fm from wellington sometimes).

By moving my main transmission 900 metres up to a ridge via a non-guardband frequency, the station covers most of the city.  I also put a repeater at Mount Maunganui where the Tauranga signal cannot be heard very well.  I don't see how this breaches the spirit of LPFM.  Two transmissions on the guardband in 2 local areas.  Perhaps MBD, you live in a reasonably flat or elevated position so you have a reasonable coverage area from where you are.

This decision may also make it illegal to tap into someone elses feed for a couple of hours for a specialty show via an Internet stream, such as what is happening now by a couple of LPFMers way across the country.  Not to mention the end of the news feed that is being discussed.

Does clause 2.2 of the new regs read that networking or linking are now banned.
If this is true I say about time as it will restore what lpfm should be used for and also free up much needed freq. being used by people (not just rhema) that want to use the lpfm band for commercial or semi commercial aplications.
